Recientemente ha entrado en vigor el Reglamento (UE) 2017/1001 del Parlamento Europeo y del Consejo de 14 de junio de 2017 sobre la marca de la Unión Europea, el cual ha introducido una serie de cambios con relación al concepto de marca de la Unión Europea, así como en los tipos de marcas que pueden ser objeto de protección. Los datos provisionales publicados por la Oficina Española de Patentes y Marcas muestran que las solicitudes de registro de patente nacional cayeron a 2.285 en 2017, lo que supone un 19,8% menos respecto al año anterior, cuando se alcanzaron 2.849 patentes. El registro de marca española, por su parte, se mantuvo estable entre enero y diciembre de 2017, sumando un total de 52.029 registros con una muy leve caída del 0,1%. (+)
El 30 de noviembre de 2017, la Federación Rusa firmó el Acuerdo de La Haya sobre el Registro de Diseños Industriales. Esto significa que a partir del 28 de febrero de 2018, las empresas y diseñadores pueden utilizar el Sistema de La Haya para proteger sus diseños industriales en la Federación Rusa. Gracias al Sistema de La Haya los propietarios de los dibujos y modelos pueden proteger esos activos incurriendo en un mínimo de formalidades y gastos. Lehmann & Fernández has renewed for the fifth consecutive year the cooperation agreement signed with AJE Aragón, the purpose of which is to provide free-of-charge advice in Industrial and Intellectual Property matters for the members of the association. In the act of the signing of the renewal, AJE Aragón expressed their interest in extending the participation of Lehmann & Fernández in IP training with face-to-face courses, as well as the regular submission of information in order to broaden the knowledge of the members of the association in trademark, patent and industrial design matters. It is expected that as of June 1, 2016, applicants for European patents with Spanish priority shall be exempt from filing with the European Patent Office (EPO) a copy of the report on the state-of-the-art drafted by the SPTMO.
This exemption, which is made pursuant to Rule 141 (1) EPC, will take place on the scheduled date after publication of the Decision of the President on the website of the EPO and in the EPO Official Journal.
The application of Rule 141 (1) EPC to applicants with Spanish priority has been possible thanks to the implementation of the so-called Utilization Implementation Program (UIP) for the electronic interchange of data concerning prior art searches during the year 2015 by the SPTMO and the EPO.
